Former Cop Convicted in Deadly Accident

On Wednesday, February 15th a jury found 56-year-old former police officer guilty on multiple charges for his involvement in a deadly crash on April 19th, 2011. William Bell collided with a vehicle head-on, and the other driver, 50-year-old Barbara Brown, was killed as a result of the Pennsylvania car accident. Bell was a Philadelphia police officer for 14 years before joining the secret service and then obtaining a private investigator’s license in 1993. He was found guilty of homicide by vehicle while driving under the influence (his BAC was almost 3 times the legal limit) among other charges and faces a minimum sentence of 3 to 6 years in prison.

According to Homicide by vehicle while driving under influence – 75 Pa. Cons. Stat. § 3735, “any person who unintentionally causes the death of another person as the result of a violation of section 3802 (relating to driving under influence of alcohol or controlled substance) and who is convicted of violating section 3802 is guilty of a felony of the second degree when the violation is the cause of death and the sentencing court shall order the person to serve a minimum term of imprisonment of not less than three years.”

Officer Sentenced for DUI Accident which Injured 3

On Wednesday, December 7th, a former Philadelphia police officer was sentenced to 11 ½ to 23 months in jail in relation to a car accident on February 20th, 2010 which injured two state troopers and a tow-truck driver. At 3:30 a.m. a police cruiser and a tow-truck responded to an abandoned vehicle on I-95 near Girard Avenue. Off-duty Philadelphia police officer, Matthew Sharkey, 25, was intoxicated when he drove his personal vehicle through the warning flares and rear-ended the parked police cruiser.

State trooper, Matthew Sheeran, whose legs were crushed between the police cruiser and the abandoned car as a result of the accident, sustained the most severe injuries. Matthew Sharkey, a member of the Philadelphia police force since 2007, was fired following the Pennsylvania car accident. In June, Sharkey pleaded guilty to aggravated assault by vehicle while intoxicated and other charges related to the accident. Matthew Sharkey is expected to report to prison on January 3rd to serve his sentence, which is accompanied by six years of probation.

According to Pennsylvania state law 3735.1, aggravated assault by vehicle while driving under the influence is defined as “any person who negligently causes serious bodily injury to another person as the result of a violation of section 3802 (relating to driving under influence of alcohol or controlled substance) and who is convicted of violating section 3802 commits a felony of the second degree when the violation is the cause of the injury.” This law defines “serious bodily injury” as “any bodily injury which creates a substantial risk of death or which causes serious, permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ.”

30-Year-Old Law Prevents Woman from Receiving Full Settlement

A woman was just awarded $14,000,000 by a Bucks County, PA jury for injuries she sustained from an accident in 2007, and rightly so. The plaintiff was run over by a Pennsbury school bus, which resulted in the amputation of her left leg above the knee, a crushed pelvis, and other fractures—she was only 17 when the accident occurred. Although she rightfully deserves to be compensated, a decades-old law will only allow her to receive $500,000 of the damages.

According to a PA state law that was formed back in the 1980s states that the legal liability of all governments, including school districts, is limited to a cap of $500,000. The Pittsburgh Post-Gazette reported that this case could be used to test the validity of the 30-year-old law.

The verdict sheet said that the plaintiff was awarded $338,580.49 for past medical bills, $2,597,682.90 for future medical costs, and $11,100,000 in other damages. The jury was unanimous in their decision on how much the woman was to receive, but that seems futile since this law prevents it.

The attorney plans on challenging the cap to test the legality and constitutionality of the law. In court, the defense did not detest the fact that the woman should be compensated for her injuries, but they argued that sympathy could get in the way of what a reasonable amount of damages would be.

The Gazette reported that in the defense’s opening statements they said, “We agree, Ashley deserves reasonable compensation for her injuries. … But one of the things and one of the reasons why you’re all here is because you promised that you would be able to put aside the sympathy at the end of the day, at the end of the trial, and make a decision on the damages that were reasonable and necessary.”
