Appellate Court Victory: Console & Hollawell Creates New Case Law in Fight Against Insurance Company - Pending

Firm partner Richard J. Hollawell achieved a major victory for consumers’ rights in his fight against New Jersey Manufacturers Insurance Group (NJM). The new case law published as the result of our fight against NJM will essentially prevent insurance companies from aggressively litigating arbitration awards when the amount the insurance company is responsible for is less than $15,000. The dispute arose from an uninsured motorist claim our client had with his insurance company, NJM. Despite the fact that NJM was responsible to pay our client less than $15,000, they were refusing payment. In their attempt to get out of paying our client with the money that was due to him the insurance company spent approximately $30,000 to fight a $14,574 arbitration award.

NJM tried to assert in court that they were not required to pay our client because the total arbitration award in this matter was $29,000 and, as of… Read More »

Medical Malpractice - $1,650,000

$1.65 million

Burying a child, at any age, is an unimaginable tragedy for a mother. For our client, that terrible event played out over many months, while her son was supposedly under the care of experienced medical doctors. The high doses of prescription medications our client’s son received from these doctors to manage his pain had lethal consequences and directly caused his untimely death. Physicians continued to prescribe the deadly cocktail of pills even as our client’s son began to show signs of organ failure and pharmaceutical poisoning.

Having just lost her son, a despondent mother turned to our firm to help hold those responsible for his death accountable.

Our attorneys delved into the professional histories of the medical doctors at the center of this wrongful death case. What they found read like a laundry list of suspect practices from a tendency to operate as ‘cash only’ healthcare… Read More »

Brain Injury - $1,500,000

$1,500,000

When medical error leads to injury it can be difficult enough to cope with, but when that error leads to the death of a child it is unbearable. One of our clients had a baby in 2004 who was born three months early. As with most preemies, she had respiratory issues and some problems with her lungs, which required she live the first eight months of her life in the hospital.

When she was finally able to go home, she still required medical care as her development was still delayed. She had a tracheotomy through which her breathing was assisted by a ventilator. In order to receive the added care she needed, her parents had a home healthcare nurse come to their home each day to assist with her medical needs.

Her loved ones described her as a happy child full of energy, personality, and strength, and just three… Read More »

Personal Injury - $900,000

$900,000

In 2007 she was just a normal nine-year-old girl who enjoyed roller skating, jumping rope, and school. Then tragedy struck, and all of that went away.

She was spending the weekend with her father and sister and her cousin. When her father was called into work on an emergency project, he had no one to watch the children, so he brought them along. He was working for a company, Solid Surface Design, that fabricated countertops and cabinetry. In the course of his duties that day, he needed to operate a fork lift.

Our client, her sister, and her cousin were nearby when her father was using the forklift. He saw them and told them to move away, the owner as well as two foremen were also close by watching—no one expected what happened next.

The forklift came closer and closer to the children and our client was unable… Read More »

Worksite Injury - $825,000

$825,000

Construction sites can be high risk areas for accidents if companies and their general contractors don’t take appropriate steps to ensure the safety of workers. Injuries sustained by construction workers in partially-built structures can be significant, especially when hazards are partially concealed. Companies that are lax in their adherence to workplace safety regulations place everyone at risk, including pedestrians who might be walking by the sites. Our client, a carpenter working on an office building project in Moorestown, experienced the tragic outcome of such a failure in safety protocols firsthand.

While working at the construction site, our client stepped into an 18-inch-deep hole in the building’s concrete flooring. The sudden drop caused his back to twist violently. He crumpled to the floor in severe pain. Barely able to walk, let alone work, he sought medical attention for his injuries. Doctors discovered multiple herniated discs in his back and… Read More »

Failure to Diagnose Cancer - $750,000

$750,000

What started as an emergency room visit for minor injuries sustained in an assault could have turned into a medical miracle. Doctors could have told our client that they’d found a mass in his lung, a small one, detected on a routine X-ray. They could have told him that, by sheer luck, they’d caught the cancer at the exact right time, that he had an excellent chance for survival. His life could be saved.

All those things could’ve happened, but none of them did.

Our client’s doctors did indeed find an early-stage cancerous nodule in his chest on an X-ray, even noted it in his chart, but, through their neglect, never told him about it. Five years later, it had grown significantly causing him to experience a persistent cough and shortness of breath. Concerned about his symptoms, our client returned to the same hospital where he’d received… Read More »

Hit and Run Accident - $635,000

$635,000

Our client has no memory of the station wagon that ran him over as he biked through an affluent neighborhood in the Philadelphia suburbs. His simple bike ride to a friend’s house had turned suddenly violent, the impact knocking the teenager from his bicycle and into the street. Emergency responders airlifted him to a nearby hospital.

The driver, Suzanne K. Lammers, had fled the scene in the face of approaching sirens and emergency vehicles. She would later tell police she believed she hit a deer, but that excuse failed to explain why she attempted to hide her damaged vehicle in a garage away from public view. When found, her vehicle showed clear evidence of being involved in a hit-and-run crash.

Our client sustained serious injuries, including a fractured skull and leg bone, requiring a hospital stay and months of physical rehabilitation. Seeking to hold Lammers accountable for… Read More »

Multi-Level Neck Fusion - $610,000

$610,000

Sitting in traffic on a rainy afternoon can be enough of an issue without being involved in an accident. On a rainy March day, our client was stopped in traffic on Route 73 near the entrance to the New Jersey Turnpike. Suddenly she was struck violently from the rear, causing serious damage to her car and even more serious physical damage to her.

Because the roads were damp from the day’s rain, drivers needed to use added caution as it takes longer for their car to come to a full stop. The other driver should have taken more care when approaching a well-known, high traffic area like that, but instead of stopping they hit our client at approximately 30 miles per hour.

Following the accident, our client went to the hospital complaining of knee and neck pain as well as pain radiating in her leg and buttocks. Her… Read More »

Rear-ended by Commercial Vehicle - $515,000

$515,000

A driver who takes their eyes off the road, even for a second, turns their vehicle into a blind missile. Our unsuspecting client learned just how much damage a careless driver can do when their inattention combines with poor road conditions. Stopped at a red light on a rain-swept road, our client’s life changed forever when a commercial truck plowed into his own vehicle. The sheer force of impact pushed him into the intersection in the face of oncoming traffic where he sat vulnerable to additional collisions. The commercial truck driver readily admitted that, “he wasn’t paying attention” and “couldn’t stop his vehicle.” Our client, dazed and groggy from the crash, reported back and neck pain to hospital staff later in the day. Believing his injuries to be minor, he initially attempted to manage his pain with over-the-counter medication.

Then, the pain got worse. And worse. And worse.

Intestinal Trauma - $450,000

$450,000

A night of enjoying time with friends quickly became, with no notice, one of the worst days of our client’s life.

It was nearly five in the morning in June 2010, and our client was a backseat passenger in a car with some of her friends. As dawn approached, she fell asleep, lulled by the moving vehicle. Suddenly she was jilted awake as her friend lost control of his vehicle and struck a tree.

She was forced from peaceful slumber and wound up clenching her abdomen and chest in pain, barely responsive. When the accident responders arrived on the scene, all of the occupants had to be cut from the car with the jaws of life.

She and her friends were all transported to Hunterdon Medical Center. As a result of the car accident, our client suffered damage to her small intestine, a broken rib, a broken sternum,… Read More »

Spinal Injury - $443,000

$443,000

Our client’s trip down the New Jersey Turnpike, a route he took often, would be one that would forever change his life.

While innocently waiting his turn in line to pay the toll near Exit 4 in Mount Laurel, our client was rear ended when a man carelessly drove into another car causing that car to hit our client’s vehicle with a huge impact. At the scene, police officers issued a summons for careless driving to the driver of the van that caused the accident. Our client was taken directly from the scene of the accident to the hospital by ambulance.

At the hospital, he was diagnosed with cervical (neck) strain and lumbar (back) strain and was instructed that he could not return to work the next day and needed to follow-up with an orthopedic surgeon. Through further diagnostic testing and examination by specialists it was determined that as… Read More »

Hearing Loss & Disc Herniations - $427,000

$427,000

Watching a truck careen out of control towards you is the stuff of nightmares come true. Life breaks down into agonizing seconds, each tick of the clock bringing the vehicle closer to its violent impact. Our client, a mechanic on his way to work, lived through such a wreck. The driver of a commercial Canada Dry delivery truck plowed recklessly through an intersection, making a left-hand turn into the path of our client’s own car. Our client hammered his car horn repeatedly to get the commercial driver’s attention, but could only watch helplessly as the huge vehicle struck him. Adrenaline flooded his system as his body tensed with the impact. He refused treatment at the scene, that is, until the accident’s heady haze wore off. Faced with growing pain radiating throughout his back and neck, he sought help from a nearby emergency room. Medical personnel hovered above him, examining… Read More »

Back herniations - $290,000

Drowning to death in a parking lot isn’t a risk most people take into consideration when riding their bicycles. For one man, it nearly became a reality. Our client was riding his bicycle through a strip mall’s parking lot when he spied a still puddle of water. Remembering happy moments from childhood days, he angled for the small pool, eager to splash through it. That motionless swath of water was actually a two-foot-deep hole in the ground. Our client’s childhood nostalgia turned into life-threatening danger as his front tire plunged downward. He flipped over the bike’s handlebars and landed face-first in the concrete pit.

“Thank God there were good people there to help me,” he said recalling the incident. “I would’ve drowned.”

After the accident, strip mall staff placed an orange cone in the center of hole. But, for our client, the damage had already been done.

Post-Traumatic Fibromyalgia - $245,000

$245,000

Not hiring an attorney who will fight aggressively to win you the proper compensation could result in a quick settlement for much less money than you deserve. One of our clients had first retained a different attorney who urged her to settle her claim for only $34,000. Knowing that her severe and permanent injuries called for more compensation than that, she contacted our firm for a second opinion.

Her car accident occurred in February 2005 when a driver exiting the Washington Township High School parking lot ignored our client’s right of way and proceeded to make a left turn in front of her.

Just some of her many debilitating injuries included multiple herniated disks to both her neck and back, post-traumatic fibromyalgia (deep pain throughout the body), and pain radiating into her arms and legs as the result of the disc herniations in her back and neck.… Read More »

Disc herniations - $252,000

Traffic signals are not suggestions; they are there to allow traffic to flow effortlessly without the risk of accidents at major intersections. When someone blatantly disregards a traffic signal and proceeds through an intersection causing a collision, they must be held responsible for their negligent actions.

No one can foresee someone running a stop light in this manner as was the case when one of our clients was driving his car in Reading, Pennsylvania. When our client proceeded through the green light he was suddenly and violently struck by the defendant who ran a red light—the impact send his car flying into several other vehicles and shattered his windshield.

Police officers were called to the scene and issued a citation to the defendant driver for disobeying a red light. Our client was taken to the hospital where he was diagnosed as having sustained a herniated disc in his… Read More »

Severely broken arm - $230,000

Making some extra money while on summer break is a normal occurrence for many college students. They pick up shifts at restaurants, mow a few lawns, or devote a couple days to retail sales. For our client, taking a job with a local home improvement contractor was supposed to be a quick way to earn some summer cash. The negligence of the contractor in charge of the site turned a hard day’s work into nearly a week in the hospital and a long-term battle with injuries.

Our client, made to perch on rickety scaffolding while engaged in work duties, plummeted 30 feet to the ground below after its framework collapsed without warning. The impact snapped the bones in his right arm in half. He also sustained multiple lacerations to his hands, dislocated his thumb, bit through his bottom lip and suffered a nose fracture. An auto accident does more than wreck a vehicle – it can fundamentally change your daily activities; rob you of all the little things you used to take for granted. For a pedestrian, an accident with an automobile almost assures some type of serious injury. For our client, a pedestrian in the middle of his workday, one driver’s reckless actions stole all his simple life enjoyments and nearly cost him his livelihood.

“Suddenly, I saw the gentleman in front of my car,” the driver told the first police officer on the scene. For the driver, our client’s appearance may have seemed sudden, because their attention was anywhere but on the road in front of them. The driver had struck our client as he crossed the street, only applying her brakes after the sudden impact. In fact, our client was more than 80 percent of the way across the… Read More »

Traumatic brain injury - $225,000

Trauma inflicted to the head in a car accident can severely impact the life of the victim, as was the case with one of our clients.

Our client was travelling westbound in Philadelphia and began to make a left turn when she had the green arrow at a traffic light. As she was making the turn, the defendant who was travelling eastbound on the same road, disregarded the red light and proceeded through the intersection, slamming into the side of our client’s car.

Following the accident, our client was immediately transported to Frankford Hospital, which would end up being only one stop on her long road to recovery. The same day of the accident, she had to be airlifted from the first hospital to Thomas Jefferson University Hospital, where she remained for nearly two weeks. In addition to a broken vertebra in her neck, our client also suffered… Read More »

Spinal Disc Herniation - $200,000

$200,000

A rear-end collision happens with little warning. A driver may only see a flash of headlights in his rearview mirror before the vicious impact shoves his body forward, pushes his own vehicle into traffic. The force involved in such a wreck wreaks havoc on the human body, potentially damaging the spine, breaking bones and tearing muscle tissue. Our client experienced just how pervasive rear-end car accident injuries can be, and how fighting for deserved compensation can be an uphill battle without experienced legal representation.

Struck from behind while stopped for traffic, our client immediately experienced pain in his neck as a result of the crash. He was able to drive to the emergency room where doctors prescribed him medication for his pain and advised him to follow up with an orthopedic surgeon. Because our client was injured during while on the job, he initially went through the worker’s… Read More »

Fractured Ankle - $145,000

$145,000

Injuries from a slip-and-fall accident take an enormous toll on the human body. The forces exerted on muscle and bone during a sudden impact can cause tears throughout the affected tissue, which may then cause problems in other areas. For example, a back injury from a fall may lead to nerve damage, which can cause burning sensations or tingling in the hands and feet. The loss of sensation can bring an active lifestyle screaming to a halt. Our client learned this fact all too well, because it happened to her.

As the liaison to a foreign ambassador and frequent caregiver for her grandchildren, our client never stopped moving. She regularly attended public events and charity functions even as she helped take the grandkids to school. While at one such function at a resort in upstate New York, our client was attempting to walk down an old stone staircase.… Read More »

A distracted driver failing to notice the red light turns your vehicle into a sitting duck. You might never see the vehicle coming until you feel the crash – our client certainly didn’t.

An electrical truck smashed into the rear of our client’s vehicle as he waited at a red light one summer afternoon. Our client sustained multiple injuries across his body including severe herniation of several discs in his back compressing the spinal cord, which caused radiating pain throughout his limbs. The crash also damaged his wrists and aggravated existing physical difficulties. In an instant, he… Read More »

Disc herniation - $200,000

Vehicles with rusted or worn components can be road hazards waiting to happen. At any moment and without warning, a part can break in two causing the driver to lose control and crash into other cars sharing the road. Such a collision can lead to severe injuries for anyone involved. Our client was the victim of such a reckless disregard for proper vehicle maintenance as she traveled down a busy street in Philadelphia. She watched a commercial truck owned by Industrial Weighing Systems Inc. rumble down the road in the opposite direction. At first, she paid the towering vehicle no mind.

The pressure students feel to perform well and earn high grades in their classes can put them in some dangerous situations. Teachers may easily disregard important safety protocols that protect students from harm in the name of producing high-quality performances and earning praise from their colleagues and supervisors. Educators who lose sight of their highest obligation – the safety of their students – are no better than careless drivers speeding recklessly down the highway. Our client, a teenaged girl trying to obey her teacher despite her fears, is living proof of just how appropriate that comparison is.

While in a physical education class, our client was partnered with another student during swing-dancing lessons. The routines the teacher was directing them to perform incorporated a number of lifts and flips that most adults would find challenging. She repeatedly voiced her concerns about the moves to her teacher, who only… Read More »

Fractured Shoulder - $150,000

Rolling through a stop sign isn’t the same as coming to a full and complete stop to look for oncoming traffic. Disobeying a traffic signal, whether it’s running a red light or failing to yield, potentially places every other driver on the road in harm’s way. For our client, a motorist showing that type of disregard for the rules of the road changed her life forever. The event happened on a straight road in the middle of the afternoon. A driver blew through a stop sign and swung her vehicle into traffic, directly in the path of our client’s own car. A terrible collision followed.

The impact fractured our client’s shoulder at the socket and tore through cartilage. Examinations by emergency room doctors also showed nerve impingements and compression fractures in the middle of her back. The damage to our client’s shoulder was so significant she required invasive surgery… Read More »

Truck Accident - $350,000

Even a single broken piece of glass can cause a life-altering injury, which can happen at any time, in any location. Our client, just a child sitting in the backseat of her father’s car, knows this all too well.

A commercial water delivery truck collided head-on with her dad’s car, a headlight from the truck dislodged and flew through the windshield. Accident survivors can face grueling therapy and multiple surgeries as they attempt to recover from their injuries.
